Who these terms are with

This website and its ordering are run by Winegar's Coffee & Creamery, the trade name of GARIKO LLC, a Washington company, at 1013 East University Way, Ellensburg, WA 98926. Using this site, or placing an order on it, means these terms apply between you and us.

Orders are for pickup at Winegar's

Everything ordered on this site is made for pickup at our shop. We do not ship and we do not deliver. Your order names the day and the location to come to, and the Milk Run's whole idea is that you order the night before and pull up the next morning. We keep it cold until you come by.

Getting your details right is your part

Please check your order and your contact details before you pay. We make what the order says, and we reach you at the email address and phone number the order gives us. A typo in an email address is the most common reason a confirmation never arrives, and a wrong choice on an order is a jug made the way it was asked for.

You must be old enough to enter a contract where you live, and the details you give us must be your own and accurate.

Prices, taxes and paying

Prices are shown on the order page in US dollars. Sales tax is calculated and shown as its own line before you pay — the total on the screen is the total you are charged, with nothing added afterwards.

Payment is taken by Stripe, our payment processor, on Stripe's own secure payment page. We never see or store your full card number. Your order is confirmed when Stripe confirms the payment; until then nothing is made and nothing is owed. If a payment does not complete, the order simply does not exist.

We do our best to keep prices and availability right, but if something is listed at an obviously wrong price, or we cannot make what you ordered, we will contact you and refund you in full rather than quietly substitute something else.

Changes, cancellations and refunds

• Before we have made it — a change or a cancellation is usually no trouble at all, and a cancellation is refunded in full.
• Once it is made, or once it has been picked up — food and drink is perishable, so a prepared or collected order may not be refundable. That is the rule; it is not how we like to behave. In practice we handle these case by case and we would far rather make it right than be right.
• If something is wrong with your order — wrong item, something not up to standard, anything at all — tell us and we will remake it, refund it, or both. This is not a fight you should have to have.
• If you do not collect an order and we have not heard from you, we cannot hold perishable product indefinitely. Get in touch and we will do what we reasonably can.

Nothing here takes away rights you have under Washington or federal consumer law, and we will always honor a refund the law requires.

Allergies and what is in our food

Our kitchen handles milk, eggs, wheat, soy, tree nuts and peanuts, and our ice cream is churned on shared equipment, so we cannot promise any item is free of a given allergen. If you have an allergy, ask us before you order and we will tell you honestly what we know.

Using this website

You are welcome here. Please do not attempt to break into, overload or interfere with the site, place orders you do not intend to collect or pay for, scrape it wholesale, or use it to do anything unlawful. We may refuse or cancel an order, and refund it, if we believe it is fraudulent or abusive.

Our name, logo, photographs, flavor names and the writing on this site are ours. Please do not reuse them commercially without asking; asking is easy.

What we can promise, and what we cannot

We keep this site accurate and running, but we cannot promise it will always be available or entirely free of mistakes — hours, prices and what is on the board change, and a page may be briefly out of step with the shop. To the extent the law allows, the site and its content are provided as they are, and our responsibility for any order is limited to what you paid for that order. Nothing in these terms limits liability that cannot legally be limited, including for death or personal injury caused by negligence, or for fraud.

Changes to these terms

If these terms change we will post the new version here and move the date at the top. The terms that apply to an order are the ones posted when you placed it.

Law

These terms are governed by the laws of the State of Washington, and Kittitas County, Washington is where any dispute about them belongs.
